DAMC 05 Veranstaltungs-GmbH is responsible under the general laws as a service provider pursuant to § 3 No. 1, § 8 (1) of the Telecommunications Services Act (TDG) (as of December 14, 2001) for its own information that is kept available for use.

Of these own contents, cross-references („links“) to content provided by other providers must be distinguished. The content of other providers transmitted or stored via „links“ is external information and not the own content of DAMC 05 Veranstaltungs-GmbH. However, „links“ are always „live“ (dynamic) references. Upon initial linking, DAMC 05 Veranstaltungs-GmbH did verify the external content to ensure that it does not trigger any possible civil or criminal liability. However, according to the TDG, DAMC 05 Veranstaltungs-GmbH is not obliged as a service provider to monitor the information it transmits or stores or to investigate circumstances indicating illegal activity (§8(2) TDG). Only when it is determined or pointed out by others that a specific offer for which a link has been provided may give rise to civil or criminal liability, will the reference to that offer be removed. In detail, the TDG regulates the liability of the service provider as follows:

DAMC 05 Veranstaltungs-GmbH is not responsible for the transmission of any external information if DAMC 05 Veranstaltungs-GmbH

1. which did not cause this,
2. has not selected the address data of the transmitted information, and
3. the information transmitted has not been selected or modified (§ 9(1) TDG)

The DAMC 05 Veranstaltungs-GmbH is not responsible for the automatic, time-limited temporary storage of other people's information if:

1. the information is not changed,
2. observes the conditions for accessing the information,
3. observes the rules for updating the information set out in widely accepted and used industry standards,
4. does not interfere with the permitted use of technologies for collecting data about the use of information that is defined in widely accepted and used industry standards, and
5. act immediately to remove stored information or to block access to it as soon as it becomes aware that the information has been removed from the original point of transmission or that access to it has been blocked, or a court or administrative authority has ordered the removal or blocking (§10 TDG). 

The DAMC 05 Veranstaltungs-GmbH is not responsible for any information that it stores for a user, unless

1. has no knowledge of the unlawful act or information and is also not aware of any facts or circumstances in the event of claims for damages that clearly indicate the unlawful act or information; or
2. immediately took action to remove the information or to block access to it as soon as it became aware of it (§ 11 TDG).
